Description

ERISA (Employee Retirement Income Security Act of 1974) created certain fiduciary liability exposures for benefit plans governed by ERISA. This course describes the basic fiduciary duties set forth by ERISA, analyzes claim exposures that can arise from these duties, and provides a detailed look at specific provisions within fiduciary liability insurance policy forms that address these exposures. Learning Objectives Upon completion, students will be able to: identify the types of plans impacted by ERISA regulations and the specific fiduciary duties and standards of care imposed by ERISA; identify the most common fiduciary liability exposures; identify the key elements of fiduciary liability policies, including the major insuring agreements, who is covered, and key coverage extensions, exclusions, and conditions; and recognize how fiduciary liability policies can be coordinated with other types of management liability policies.
